National Independent School Alliance (NISA) serves defamation notice to Shri Govind Singh Dotasra, State Education Minister, Government of Rajasthan, demanding an apology or Rs 10 crores as defamation proceedings.
The legal notice dated 10th November 2020 states that the minister defamed the names of member schools of NISA in a press conference. “By giving derogatory words against the pious profession of education, your briefing hurts the image of schools in the eyes of the general public. Thus, NISA is going to initiate the action against you under the provisions of defamation by seeking the compensation of Rs. 10 crores for your derogatory remarks through its National President, Dr. Kulbhushan Sharma.”
The association is disappointed in the minister for using words like ‘Dhandha’ against the entire school management.
Talking to ScooNews, Dr. Kulbhushan Sharma stated, “In India, the Guru (teacher) is associated with the highest power in the universe. And here we are using such words to diminish their sacred profession. It’s not only against our constitution, but it also hurts the values of many educators. Teachers are nation-builder, how can we call their work a mere ‘Dhanda’ or trade/commercialisation?”
The notice also mentions – “In our society, education is treated as a very pious profession which has been upheld up to Hon’ble Supreme Court of India in various of its judgements. By using the derogatory word like ‘Dhandha,’ you have not only hurt the sentiments of the school managements and the staff working in those schools, your act and conduct is against the law upheld by the Hon’ble Supreme Court of India in various of its judgements including TMA PAI’s judgement.”
NISA comprises of several unaided private schools from around the state for whom financially surviving the lockdown during the school shutdown remained fairly difficult.
NISA members are now seeking justice by asking the state’s Education Minister to take responsibility for his disparaging statement(s) and apologise immediately. In case the apology doesn’t appear within 15 days, the association plans to initiate the defamation proceedings against the minister for the amount of Rs. 10 crores in the Rajasthan High Court.
